These Terms of Service ("Terms") constitute a legally binding agreement between you and yrrabkram, LLC ("Kyrtn," "we," "us," or "our"), governing your access to and use of the Kyrtn platform, website, and related services (collectively, the "Service"). Please read these Terms carefully before using the Service.

BY CREATING AN ACCOUNT, MAKING A PURCHASE, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

If you are using the Service on behalf of an organization, company, department, or other legal entity, you represent and warrant that you have the legal authority to bind that entity to these Terms, and references to "you" include both you individually and that entity. If you do not have such authority, you may not use the Service on that entity's behalf.

1. The Service

Kyrtn is a digital program platform for live performance organizations, operated by yrrabkram, LLC. The Service enables organizations to create and publish digital programs for productions including theatre, dance, music, opera, and related disciplines. Individual performers, designers, crew members, and other production contributors may claim credits published in those programs to create a verified production history on their Kyrtn profile.

Credits on Kyrtn are verified by the publishing organization. Kyrtn does not independently verify the accuracy of any credits, program content, or other information submitted by users, and is not responsible for any errors, omissions, or inaccuracies in user-submitted content.

2. Eligibility

You must be at least 13 years old to create a Kyrtn account. By creating an account, you represent and warrant that you are at least 13 years of age. If you are between 13 and 17 years old, you represent that you have obtained the consent of a parent or legal guardian to use the Service, and that your parent or guardian has reviewed and agreed to these Terms on your behalf. Your parent or guardian assumes full responsibility for your use of the Service.

Kyrtn does not knowingly collect personal information from children under the age of 13 without verifiable parental consent, consistent with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. sections 6501 through 6506. If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will take immediate steps to delete that information. If you are a parent or guardian and believe your child under 13 has created an account or submitted personal information to Kyrtn without your consent, please contact us immediately at privacy@kyrtn.com.

By using the Service, you represent and warrant that you have the legal capacity to enter into a binding contract in your jurisdiction. If you are located in the European Union, you must be at least 16 years old, or such other age as required by your member state, to consent to the processing of your personal data.

No individual under the age of 13 may be credited in a program published on Kyrtn. Organizations are prohibited from submitting credits for individuals they know or reasonably should know to be under the age of 13. By publishing a program, the organization represents and warrants that no credited individual is under the age of 13, or that verifiable parental or guardian consent has been obtained and is on file with the organization for any credited individual under the age of 13. Kyrtn will remove credits for individuals under 13 immediately and completely upon a verified request from a parent or legal guardian, without requiring organization consent.

3. Accounts

You are solely and fully responsible for all activity that occurs under your account, whether or not you authorized it. You agree to maintain the confidentiality of your login credentials and not to share them with any third party. You agree to notify us immediately at hello@kyrtn.com if you know or suspect unauthorized access to or use of your account.

Kyrtn will not be liable for any loss, damage, or harm arising from your failure to maintain the security of your account credentials or from unauthorized access resulting from your actions or inactions.

You may not create more than one personal account. Organizations may not create duplicate organization accounts without our prior written consent. We reserve the right to merge, suspend, or terminate duplicate accounts at our sole discretion.

You agree to provide accurate, current, and complete information when creating your account and to update that information as necessary to keep it accurate. Kyrtn reserves the right to suspend or terminate accounts that contain materially false or misleading information.

4. Organization Responsibilities

Organizations that publish programs on Kyrtn assume full legal and ethical responsibility for the content they publish. Specifically, each organization represents, warrants, and agrees that it:

  • Has the full legal right and authority to publish all content submitted to Kyrtn, including production titles, program copy, cover art, photographs, sponsor logos, and other materials
  • Has obtained all necessary rights, licenses, clearances, and permissions for all content it uploads, including any copyrighted materials
  • Has the right to publish the full legal name and role of every individual it credits in a program, and has complied with all applicable privacy laws in doing so
  • Has complied with the requirements of Section 2 with respect to credited individuals under the age of 13
  • Will not publish fabricated, false, or materially misleading credits or program content
  • Will not publish credits for individuals who did not participate in the named production in the stated capacity
  • Has informed or will inform credited individuals that their name, role, and production information will appear publicly on Kyrtn and may be claimed as part of a Kyrtn profile

Kyrtn is not a party to any agreement, relationship, or dispute between an organization and any individual it credits. All such matters are solely between the organization and the credited individual. Organizations agree to indemnify and hold Kyrtn harmless from any claims arising from credits they publish. See Section 14 (Indemnification).

5. Credits and Profiles

When an organization publishes a credit, that credit appears publicly on Kyrtn associated with the credited individual's name. The credited individual may claim that credit by creating or logging into a Kyrtn account, at which point the credit will appear on their verified Kyrtn profile.

Unclaimed credits remain associated with a stub profile entry until claimed by the individual or removed by the publishing organization. Stub profiles are not full user accounts and do not constitute personal accounts under these Terms.

By claiming a credit, you represent and warrant that the credit accurately reflects your genuine participation in the named production in the stated role. Claiming a credit you did not earn is a material violation of these Terms and may result in immediate account suspension or termination.

Kyrtn profiles are public by default. If you wish to make your profile private or request removal of a credit or your personal information, see Section 11 (Your Privacy Rights).

6. Content and Intellectual Property

Your content. You retain full ownership of all content you submit to Kyrtn, including program copy, production information, cover art, biographical information, headshots, and other materials ("Your Content"). By submitting Your Content to Kyrtn, you grant Kyrtn a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, copy, display, reproduce, and distribute Your Content solely as necessary to operate, maintain, and provide the Service. This license terminates when you remove Your Content from Kyrtn or delete your account, except to the extent Your Content has been incorporated into historical records, cached copies, or shared with other users prior to removal.

Kyrtn does not claim ownership of Your Content. Kyrtn will not license, sell, or otherwise commercialize Your Content to third parties, and will not use Your Content for advertising or marketing without your explicit written consent.

Your representations. You represent and warrant that: (a) you own or have all necessary rights to Your Content; (b) Your Content does not and will not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, rights of publicity, or other rights; (c) Your Content does not contain any material that is unlawful, defamatory, obscene, harassing, threatening, or otherwise objectionable; and (d) you have obtained all necessary consents from individuals whose names, likenesses, or personal information appear in Your Content.

Kyrtn's intellectual property. The Kyrtn name, logo, platform design, software, code, and all associated intellectual property are owned exclusively by yrrabkram, LLC and are protected by applicable copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use Kyrtn's intellectual property without our prior written consent. Any unauthorized use of Kyrtn's intellectual property is strictly prohibited.

Copyright infringement. If you believe in good faith that content on Kyrtn infringes your copyright, please send a written notice to hello@kyrtn.com that includes: (a) identification of the copyrighted work you claim has been infringed; (b) identification of the material you claim is infringing, including the URL where it appears on Kyrtn; (c) your name, address, telephone number, and email address; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (e) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. We will respond to valid notices in accordance with applicable law.

7. Acceptable Use

The Service is provided for creating, documenting, and sharing programs for live performing-arts productions and the individuals credited in them. You agree that you will not, and will not permit any third party to, use the Service to:

  • Use the Service for any purpose other than documenting and sharing genuine performing-arts programs and credits, including using programs, profiles, claim emails, or QR codes as a vehicle for unrelated content, products, or campaigns
  • Send deceptive, fraudulent, or phishing communications, or distribute links intended to mislead recipients, impersonate a trusted sender, or harvest credentials or personal information
  • Publish false, fabricated, or materially misleading content, credits, or program information
  • Impersonate any person, organization, or entity, or falsely represent your affiliation with any person or entity
  • Harass, intimidate, threaten, defame, or otherwise harm any other user, credited individual, or third party
  • Upload, transmit, or distribute content that infringes any copyright, trademark, trade secret, patent, right of publicity, privacy right, or other intellectual property or proprietary right
  • Upload, transmit, or distribute content that is unlawful, obscene, pornographic, defamatory, hateful, or otherwise objectionable under applicable law
  • Attempt to gain unauthorized access to any portion of the Service, any other user's account, or Kyrtn's systems, servers, or networks
  • Use automated tools, bots, scrapers, crawlers, or other automated means to access, collect, or index any content from the Service without our prior written permission
  • Introduce any virus, malware, ransomware, or other harmful code into the Service
  • Interfere with, disrupt, or degrade the performance, security, or integrity of the Service or its underlying infrastructure
  • Use the Service to send unsolicited commercial communications
  • Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law, regulation, or treaty

Kyrtn reserves the right, but not the obligation, to monitor use of the Service for compliance with these Terms. We reserve the right to investigate suspected violations and to suspend or permanently terminate accounts, with or without prior notice, that we determine in our sole discretion have violated these Terms, pose a risk to the Service or other users, or for any other reason we deem appropriate. Termination does not relieve you of any obligations or liabilities incurred prior to termination.

8. Payment and Billing

All payments are processed by Stripe, Inc., our third-party payment processor. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy, available at stripe.com. Kyrtn does not store your full payment card information. All prices are in United States dollars unless otherwise stated.

Kyrtn offers a free tier and the following paid purchase types. Every tier, including the free tier, may publish an unlimited number of programs.

Black Box (free)

The free tier carries no charge and requires no payment method. It grants the organization the core program features (digital programs, QR codes, claim invitations, sponsor acknowledgments, and artist profiles) for an unlimited number of productions.

Single-program unlock ($49.00, one-time)

A single-program unlock grants one production the Studio feature set (its audience report, the printable program and lobby documents, and all program themes). This is a one-time, non-recurring charge. Access to that program remains available after the production closes. Single-program unlocks are non-transferable and may not be applied to a different production after use. They do not include organization-wide features such as sponsor reporting, the season report, or the Roster.

Studio subscription ($149.00 per year) and Mainstage subscription ($499.00 per year)

An annual subscription grants the subscribing organization the features of the selected tier for a period of one year from the date of purchase. Studio adds per-program audience reports, printable documents, and all program themes. Mainstage adds, beyond Studio, sponsor reporting and share links, the organization-wide season report and its public share link, and multiple administrators. Annual subscriptions renew automatically on each anniversary of the purchase date at the then-current rate unless cancelled prior to the renewal date. You authorize Kyrtn and Stripe to charge your payment method on file for each renewal.

You may cancel your annual subscription at any time through your organization's billing settings page at kyrtn.com/{orgslug}/billing, where {orgslug} is your organization's unique identifier on Kyrtn. Cancellation takes effect at the end of the then-current billing period. You will retain full access through the end of the paid period. Kyrtn does not issue prorated refunds for unused subscription time remaining after cancellation.

Kyrtn will provide at least 30 days advance written notice by email to your account email address before any price increase affects your subscription renewal. If you do not cancel before the renewal date following notice of a price increase, you authorize the charge at the new rate.

Center subscription ($1,499.00 per year)

Center is the institutional tier that adds the Roster and related organization-wide tools. It may be purchased as a recurring annual subscription through self-service checkout on the same terms as the Studio and Mainstage subscriptions above, or, for institutions that require a purchase order or a signed data processing addendum, provided under a separate annual agreement or order form billed by invoice. Where a separate agreement applies, its terms govern the Center engagement. Contact hello@kyrtn.com to arrange invoicing or a DPA.

Failed payments. If a payment fails, Kyrtn will notify you by email. We may attempt to retry failed payments. Continued failure to resolve a failed payment may result in suspension of your subscription or access until the matter is resolved.

Chargebacks. If you initiate a chargeback or payment dispute through your bank or card issuer without first contacting Kyrtn at hello@kyrtn.com and allowing us a reasonable opportunity to resolve the matter, we reserve the right to immediately suspend your account pending resolution of the dispute.

Taxes. You are responsible for all applicable taxes, levies, or duties imposed by taxing authorities in connection with your purchase. Kyrtn will collect applicable taxes where required by law.

Refunds. Single-program unlocks and legacy Lifetime Access purchases are non-refundable except at Kyrtn's sole and absolute discretion. We will generally consider refund requests submitted within seven (7) calendar days of purchase where the audience report has not been used and no document has been downloaded under that purchase. Annual subscription payments are non-refundable for the current billing period. To request a refund, contact hello@kyrtn.com with your account information and reason for the request. All refund decisions are final.

9. Legacy Lifetime Access Terms

Lifetime Access is no longer offered for purchase. For organizations that purchased Lifetime Access while it was available, that purchase grants access to the Kyrtn Service for the operational lifetime of the Service under current ownership and operation by yrrabkram, LLC.

The following limitations and conditions apply to all Lifetime Access purchases:

Definition of lifetime. "Lifetime" means the period during which Kyrtn continues to operate as a functioning commercial platform under current ownership. It does not mean the lifetime of the purchaser, the lifetime of the purchaser's organization, or any other definition of lifetime.

Service discontinuation. In the event that Kyrtn ceases operations entirely, we will provide no less than ninety (90) days advance written notice to all Lifetime Access account holders by email to the account email address on file. We will make reasonable efforts to provide data export tools during this notice period so that organizations may retrieve their program content and credit records.

Acquisition or transfer. In the event of an acquisition, merger, asset sale, reorganization, or other transfer of Kyrtn or substantially all of its assets or operations to a successor entity, that successor entity assumes these Terms at its sole discretion. Kyrtn makes no representation, warranty, or guarantee that any successor entity will honor Lifetime Access, continue operating the Service, or maintain any particular features or functionality. Kyrtn's obligations under a Lifetime Access purchase are limited to the period of operation under current ownership by yrrabkram, LLC. A change of ownership or control does not entitle Lifetime Access purchasers to a refund.

Feature changes. Kyrtn reserves the right to add, modify, limit, or discontinue specific features, functionality, or content included in the Service at any time, including features available to Lifetime Access account holders. We will make reasonable efforts to maintain core Service functionality. Feature changes, modifications, or removals do not constitute a breach of these Terms and do not entitle Lifetime Access purchasers to any refund, credit, or compensation.

Non-refundability. Lifetime Access purchases are non-refundable after seven (7) calendar days from the date of purchase, regardless of the reason for the refund request, including but not limited to dissatisfaction with the Service, changes to the Service, or cessation of operations.

Non-transferability. Lifetime Access is granted solely to the purchasing organization and may not be transferred, assigned, sublicensed, sold, or otherwise conveyed to any other individual or entity under any circumstances.

10. Third-Party Services

The Service integrates with and depends on third-party services to operate, including but not limited to Stripe, Inc. for payment processing; Supabase, Inc. for data storage and authentication; Resend, Inc. for transactional email delivery; Vercel, Inc. for hosting and infrastructure; and ip-api.com for approximate geographic data associated with anonymous program sessions. Your use of the Service is subject to the applicable terms of service and privacy policies of these third-party providers.

Kyrtn is not responsible for the availability, accuracy, security practices, or content of any third-party service. Any issue arising from the failure, interruption, or breach of a third-party service does not constitute a breach of these Terms by Kyrtn and does not entitle you to a refund or any other remedy against Kyrtn.

Links to third-party websites or services appearing on the Kyrtn platform are provided for convenience only. Kyrtn does not endorse and is not responsible for any third-party content, products, or services.

11. Your Privacy Rights

You have the right to request correction, unlisting, or removal of your personal information from Kyrtn at any time. To submit a request, visit kyrtn.com/privacy-request or email privacy@kyrtn.com. We will acknowledge your request within two (2) business days and complete the requested action within five (5) business days.

Name corrections. We will update your name across all Kyrtn records, including your profile and all associated program credits, without requiring explanation, justification, or documentation. This applies to legal name changes, gender transition, and any other reason. Name corrections are processed promptly and applied completely.

Profile unlisting. We will remove your public profile page from Kyrtn so that it is no longer publicly accessible or indexed by search engines. Your credit records within published programs will remain intact. Your account and associated data will be retained in our systems unless you request full removal.

Full removal. We will delete your Kyrtn account, remove your public profile, and unlink your personally identifiable information from your credit records. Your credited name as it appears in published program records may remain visible in those historical program records at the discretion of the publishing organization, as published programs constitute historical documents of live performances. Credits belonging to individuals under the age of 13 will be removed completely, immediately, and without exception upon a verified request from a parent or legal guardian, without requiring organization consent or discretion.

Parental requests. If you are a parent or legal guardian and you believe your child under 13 has been credited in a Kyrtn program or has created a Kyrtn account without your consent, contact privacy@kyrtn.com immediately and we will take prompt corrective action.

California residents (CCPA). If you are a California resident, you have rights under the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA), including the right to know what personal information we collect about you and how it is used; the right to delete your personal information; the right to correct inaccurate personal information; the right to opt out of the sale or sharing of your personal information; and the right to non-discrimination for exercising your privacy rights. Kyrtn does not sell or share personal information as defined under the CCPA. To exercise your rights, contact privacy@kyrtn.com.

European Union and United Kingdom residents (GDPR / UK GDPR). If you are located in the European Union or United Kingdom, you have rights under the General Data Protection Regulation (GDPR) or UK GDPR, including rights of access, rectification, erasure, restriction of processing, data portability, and objection to processing. You also have the right to lodge a complaint with your local supervisory authority. Our legal basis for processing your personal data is our legitimate interest in operating the Service, performance of a contract where applicable, and your consent where required. To exercise your rights, contact privacy@kyrtn.com.

Full details of how Kyrtn collects, uses, stores, and protects personal information are set forth in our Privacy Policy at kyrtn.com/legal#privacy, which is incorporated into these Terms by reference.

12. Disclaimers of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KYRTN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.

KYRTN DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED; (C) THE SERVICE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) ANY CONTENT, CREDITS, OR OTHER INFORMATION OBTAINED THROUGH THE SERVICE WILL BE ACCURATE, COMPLETE, OR RELIABLE.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KYRTN OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF KYRTN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY SET FORTH IN THESE TERMS FAILS OF ITS ESSENTIAL PURPOSE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KYRTN'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS OF ANY KIND ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS YOU HAVE ACTUALLY PAID TO KYRTN IN THE TWELVE (12) CALENDAR MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

THE LIMITATIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, KYRTN'S LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

14. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Kyrtn, yrrabkram, LLC, and their respective officers, directors, employees, agents, licensors, successors, and assigns from and against any and all third-party claims, demands, suits, proceedings, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees and court costs, arising out of or in any way relating to:

  • (a) your access to or use of the Service;
  • (b) Your Content or any content you submit, post, or transmit through the Service;
  • (c) your violation of any provision of these Terms;
  • (d) your violation of any applicable law, regulation, or third-party right, including any intellectual property right, privacy right, or right of publicity;
  • (e) any credits you publish as an organization, including any claim by a credited individual arising from the publication of that credit; or
  • (f) any dispute between you and any other user or third party.

Kyrtn reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Kyrtn's defense of such claim. You agree not to settle any such matter without Kyrtn's prior written consent.

15. Changes to the Service

Kyrtn reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, for any reason including maintenance, upgrades, or business decisions. Kyrtn shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service or any part thereof.

16. Changes to These Terms

Kyrtn reserves the right to modify these Terms at any time. When we make material changes, we will: (a) update the "Last updated" date at the top of this page; and (b) send written notice to the email address associated with your account at least fourteen (14) calendar days before the changes take effect. Non-material changes may take effect immediately upon posting.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service before the effective date and may request account deletion at privacy@kyrtn.com. We will not apply retroactive changes to your rights regarding Lifetime Access purchases already made.

17. Termination

By you. You may terminate your account at any time by contacting hello@kyrtn.com. Upon termination, your right to access and use the Service ceases immediately. Termination does not entitle you to any refund except as expressly provided in Section 8.

By Kyrtn. Kyrtn may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice, at our sole discretion. Grounds for termination include, without limitation, violation of these Terms, conduct harmful to other users or third parties, conduct that exposes Kyrtn to legal liability, extended periods of inactivity, or our decision to discontinue the Service.

Effect of termination. Upon termination for any reason, all rights and licenses granted to you under these Terms terminate immediately. Kyrtn has no obligation to retain your data after termination, except as required by law or as set forth in our Privacy Policy. Published program records may be retained in accordance with our data retention policies.

Survival. The following sections survive termination of these Terms: Section 6 (Content and Intellectual Property), Section 11 (Your Privacy Rights), Section 12 (Disclaimers), Section 13 (Limitation of Liability), Section 14 (Indemnification), Section 17 (Termination), Section 18 (Governing Law and Disputes), and Section 19 (General Provisions).

18. Governing Law and Disputes

These Terms and any dispute or claim arising out of or relating to these Terms or the Service, whether in contract, tort, statute, or otherwise, shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without giving effect to any conflict of law provisions.

Informal resolution. Before initiating any formal legal proceeding against Kyrtn, you agree to contact us at hello@kyrtn.com and describe the nature of your dispute in reasonable detail. You agree to attempt to resolve the dispute informally for a period of at least thirty (30) calendar days from the date of your notice before filing any legal action. Kyrtn will similarly attempt to resolve any dispute informally before taking formal action against you.

Jurisdiction and venue. If informal resolution fails, you agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts of competent jurisdiction located in Tuscaloosa County, Alabama. You hereby consent to personal jurisdiction and venue in those courts and waive any objection to jurisdiction or venue in such courts.

Waiver of jury trial. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND KYRTN EACH WAIVE THE RIGHT TO A JURY TRIAL IN ANY ACTION, PROCEEDING, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

Time limitation on claims. Any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the cause of action arose, or such claim is permanently barred.

19. General Provisions

Entire agreement. These Terms, together with the Privacy Policy at kyrtn.com/legal#privacy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Kyrtn with respect to the Service and supersede all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written, between you and Kyrtn.

Severability. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Waiver. Kyrtn's failure to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision on any future occasion. No waiver of any provision shall be effective unless made in writing and signed by an authorized representative of Kyrtn.

Assignment. You may not assign, transfer, delegate, or sublicense any of your rights or obligations under these Terms without Kyrtn's prior written consent. Any purported assignment in violation of this section is void. Kyrtn may freely assign these Terms, in whole or in part, including in connection with a merger, acquisition, or sale of assets, without your consent.

No third-party beneficiaries. These Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms.

Force majeure. Kyrtn shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, civil unrest, government actions, labor disputes, internet or infrastructure failures, or actions of third-party service providers.

Notices. Kyrtn may provide notices to you by email to the address associated with your account, by posting on the Kyrtn platform, or by other reasonable means. Notices are effective upon sending. You may provide notices to Kyrtn by email to hello@kyrtn.com. Notices to Kyrtn are effective upon receipt.

Electronic agreement. You agree that these Terms and any other agreements, notices, or communications entered into electronically satisfy any legal requirement that such communications be in writing.

Privacy Policy

This Privacy Policy describes how yrrabkram, LLC ("Kyrtn," "we," "us," or "our") collects, uses, stores, and protects information about you when you use the Kyrtn platform, website, and related services (collectively, the "Service"). This Privacy Policy is incorporated into and forms part of our Terms of Service at kyrtn.com/legal#terms.

By using the Service, you agree to the collection and use of information as described in this Privacy Policy. If you do not agree, do not use the Service.

1. Information We Collect

Information you provide directly. When you create an account, we collect your first name, last name, and email address. You may optionally provide additional profile information including pronouns, city, biography, headshot photograph, website URL, Instagram handle, and LinkedIn handle. You are not required to provide optional information to use the Service.

When your organization creates a program, you provide production information including title, dates, venue, and program content. You also provide the names and roles of individuals you credit in that program.

When you make a purchase, payment information is collected and processed directly by Stripe, Inc. Kyrtn does not receive or store your full payment card number, expiration date, or CVV. Kyrtn receives a transaction confirmation and limited billing information from Stripe.

When you contact us by email, we retain the contents of that correspondence.

Information collected automatically. When an audience member views a published program, we collect anonymous session data including: a randomly generated session identifier stored in the viewer's browser local storage; approximate geographic location derived from IP address (country, region, and city); device type (mobile, tablet, or desktop); session start time; session duration; scroll depth as a percentage of total page length; and which sponsor elements were visible on screen and for how long. This data is collected anonymously and is not linked to any Kyrtn user account. For visitors in the EU, EEA, or UK, we do not store this session identifier or collect this session data; we keep only an anonymous count that a view occurred.

We do not use cookies for tracking or advertising. We do not use Google Analytics, Facebook Pixel, or any other third-party analytics or advertising service. All analytics data is collected and stored directly by Kyrtn using our own systems.

We collect standard server logs including IP addresses, browser type, pages visited, and timestamps in connection with operating the Service infrastructure. These logs are maintained by Vercel, Inc., our hosting provider, and are used for security, debugging, and performance purposes.

Information from third parties. We do not purchase, rent, or otherwise acquire personal information about you from third-party data brokers or other external sources.

2. How We Use Your Information

We use the information we collect for the following purposes:

To operate the Service. We use your account information to create and maintain your account, authenticate your identity, and provide you with access to the Service. We use program and credit information to display programs publicly and to enable credited individuals to claim and display their credits on their profiles.

To process payments. We use billing information in conjunction with Stripe to process your purchases and manage your subscription.

To communicate with you. We use your email address to send transactional emails including account creation confirmation, credit claim notifications, claim email delivery to credited performers, payment receipts, subscription renewal reminders, and notices required under our Terms of Service. We do not send promotional or marketing emails without your explicit consent.

To provide analytics to organizations. We use anonymous session data collected from program viewers to generate engagement reports for the publishing organization. These reports include aggregate metrics such as total views, session duration, scroll depth, geographic distribution, device breakdown, and sponsor impression counts. This data is presented to organizations in aggregate and is not linked to individual viewer identities.

To improve the Service. We use aggregate, de-identified usage data to understand how the Service is used and to improve its features and performance.

To enforce our Terms. We use account and usage information to investigate and address violations of our Terms of Service and to protect the rights, safety, and security of Kyrtn, our users, and the public.

To comply with legal obligations. We may use or disclose your information as required by applicable law, regulation, legal process, or governmental request.

We do not use your personal information for advertising. We do not sell your personal information to third parties. We do not share your personal information with third parties except as described in Section 4 of this Privacy Policy.

3. Legal Basis for Processing (EU and UK Users)

If you are located in the European Union or United Kingdom, our legal bases for processing your personal data are as follows:

Performance of a contract. We process your account information, program data, and payment information as necessary to provide the Service you have purchased or signed up for.

Legitimate interests. We process server logs, security data, and aggregate analytics data based on our legitimate interest in operating, securing, and improving the Service, where those interests are not overridden by your rights and interests.

Legal obligation. We process and retain certain information as required by applicable law.

Consent. Where we rely on consent as a legal basis, you have the right to withdraw that consent at any time by contacting privacy@kyrtn.com. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

4. How We Share Your Information

Public information. Information you choose to make public on Kyrtn, including your profile name, headshot, biography, city, pronouns, social links, and credited productions, is visible to anyone who visits your profile page. Program content published by organizations, including credited names and roles, is publicly visible. You control what optional information appears on your public profile.

Service providers. We share information with third-party service providers who assist us in operating the Service, subject to confidentiality obligations and data processing agreements where required by applicable law. Our current service providers are:

  • Stripe, Inc. (payment processing). Stripe receives billing and transaction information necessary to process your purchases. Stripe's Privacy Policy is available at stripe.com/privacy.
  • Supabase, Inc. (database storage and user authentication). Supabase stores your account data, program data, and credit records on our behalf. Supabase's Privacy Policy is available at supabase.com/privacy.
  • Resend, Inc. (transactional email delivery). Resend receives your email address and the content of transactional emails sent on your behalf. Resend's Privacy Policy is available at resend.com/legal/privacy-policy.
  • Vercel, Inc. (hosting and infrastructure). Vercel hosts the Kyrtn platform and processes server logs including IP addresses in the course of providing hosting services. Vercel's Privacy Policy is available at vercel.com/legal/privacy-policy.
  • ip-api.com (approximate geographic data). When an anonymous viewer accesses a published program, we submit their IP address to ip-api.com to obtain approximate country, region, and city information for analytics purposes. This data is not linked to any user account. ip-api.com's privacy information is available at ip-api.com.

We do not sell your personal information to any third party. We do not share your personal information with advertisers.

Legal requirements. We may disclose your information if we believe in good faith that disclosure is necessary to: comply with a legal obligation, court order, or governmental request; enforce our Terms of Service; protect the rights, property, or safety of Kyrtn, our users, or the public; or prevent fraud or other illegal activity. Where permitted by law, we will notify you of such disclosure.

Business transfers. In the event of a merger, acquisition, asset sale, reorganization, or other business transfer involving yrrabkram, LLC or the Kyrtn Service, your information may be transferred to the successor entity as part of that transaction. We will provide notice of any such transfer and any material changes to this Privacy Policy as required by applicable law. You will have the opportunity to request deletion of your information before any transfer takes effect.

5. Data Retention

We retain your personal information for as long as your account is active or as necessary to provide the Service. If you request deletion of your account, we will delete or anonymize your personal information within 30 days of your verified request, except as follows:

  • Published program records, including credited names in snapshot form, may be retained as historical records of live performances at the discretion of the publishing organization, as described in our Terms of Service.
  • Credits for individuals under 13 are deleted completely and immediately upon a verified parental or guardian request, without exception and without organization discretion.
  • We retain transaction records and billing information as required by applicable tax and financial regulations, typically for a period of seven (7) years.
  • We retain server logs for a period of up to 90 days for security and debugging purposes.
  • Anonymous program session analytics data is retained in aggregate form. Because this data is not linked to identifiable individuals, it is not subject to individual deletion requests.

6. Data Security

We implement reasonable and appropriate technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, and destruction. These measures include encrypted data transmission using HTTPS for all Service communications; access controls limiting who within Kyrtn can access personal data; use of established third-party infrastructure providers including Supabase and Vercel, each of which maintains their own security programs; and use of Stripe for payment processing, which is PCI DSS compliant.

No method of transmission over the internet or electronic storage is completely secure. While we take the protection of your data seriously, we cannot guarantee absolute security against all threats. In the event of a data breach that is likely to result in risk to your rights and freedoms, we will notify affected users and applicable regulatory authorities as required by applicable law, including within 72 hours where required by GDPR.

You are responsible for maintaining the security of your account credentials. Do not share your password with anyone. If you believe your account has been compromised, contact us immediately at hello@kyrtn.com.

7. Your Privacy Rights and Choices

Regardless of your location, you have the following rights with respect to your personal information. To exercise any of these rights, visit kyrtn.com/privacy-request or contact privacy@kyrtn.com. We will acknowledge your request within two (2) business days and complete the requested action within five (5) business days. We do not charge a fee to process privacy rights requests and will not discriminate against you for exercising your rights.

Access. You may request a copy of the personal information we hold about you.

Correction. You may update most of your account information directly through your profile settings page. For corrections to credited names in program records, including name changes and gender transition corrections, contact privacy@kyrtn.com. We process name corrections without requiring explanation, justification, or documentation, and apply them completely across all Kyrtn records.

Deletion. You may request deletion of your account and personal information. See Section 5 for details on what is retained after deletion and why.

Profile unlisting. You may request that your public profile be removed from public access while retaining your account and credit history internally. Your profile will no longer be publicly accessible or indexed by search engines.

Objection and restriction. You may object to or request restriction of our processing of your personal information in certain circumstances, including where we are relying on legitimate interests as a legal basis.

Data portability. You may request a machine-readable copy of the personal information you have provided to Kyrtn.

Withdrawal of consent. Where we rely on your consent to process personal information, you may withdraw that consent at any time by contacting privacy@kyrtn.com. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

California residents (CCPA and CPRA). If you are a California resident, you have rights under the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020, including the right to know what personal information we collect, use, disclose, and sell; the right to delete personal information we have collected from you; the right to correct inaccurate personal information; the right to opt out of the sale or sharing of personal information; the right to limit the use and disclosure of sensitive personal information; and the right to non-discrimination for exercising your privacy rights. Kyrtn does not sell or share personal information as defined under California law and has not done so in the preceding 12 months. To submit a verifiable consumer request, contact privacy@kyrtn.com.

European Union and United Kingdom residents (GDPR and UK GDPR). If you are located in the European Union or United Kingdom, you have rights under the General Data Protection Regulation or UK GDPR including the right of access to your personal data; the right to rectification of inaccurate data; the right to erasure ("right to be forgotten"); the right to restriction of processing; the right to data portability; the right to object to processing; and the right not to be subject to solely automated decision-making. You also have the right to lodge a complaint with your local data protection supervisory authority. To exercise your rights, contact privacy@kyrtn.com.

8. Children's Privacy

Kyrtn does not knowingly collect personal information from children under the age of 13 without verifiable parental consent, consistent with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. sections 6501 through 6506. Users must be at least 13 years old to create a Kyrtn account, as set forth in our Terms of Service.

No individual under the age of 13 may be credited in a program published on Kyrtn. Organizations that credit individuals under 13 represent and warrant that they have obtained all necessary verifiable parental or guardian consents and that such consents are on file with the organization, as required by our Terms of Service.

If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information promptly and completely. If you are a parent or guardian and believe your child under 13 has created an account, been credited in a Kyrtn program, or submitted personal information to Kyrtn without your consent, contact privacy@kyrtn.com immediately. We will take prompt corrective action including complete removal of the child's information upon verified request, without requiring organization consent or discretion.

9. International Data Transfers

Kyrtn is operated from the United States by yrrabkram, LLC, located in Tuscaloosa, Alabama. If you are located outside the United States, your personal information will be transferred to, stored in, and processed in the United States, where data protection and privacy laws may differ from and may not provide the same level of protection as the laws of your country or jurisdiction.

If you are located in the European Union or United Kingdom, we rely on appropriate legal mechanisms for international data transfers as required by applicable law, which may include standard contractual clauses approved by the European Commission or UK Information Commissioner's Office, or other lawful transfer mechanisms. By using the Service, you acknowledge that your personal information will be transferred to and processed in the United States.

10. Third-Party Links and Services

The Service may contain links to third-party websites or services, including organization websites, ticketing platforms, and social media profiles linked from user profiles. This Privacy Policy applies only to the Kyrtn Service and does not apply to any third-party sites or services. We encourage you to review the privacy policies of any third-party sites you visit before providing personal information to them. Kyrtn is not responsible for the privacy practices, content, or data handling of any third party.

11. Do Not Track

Some browsers include a "Do Not Track" feature that signals to websites that you do not want your online activities tracked. Kyrtn does not currently respond to Do Not Track signals. We do not track users across third-party websites and do not use third-party behavioral advertising. Our analytics practices are described in Sections 1 and 2 of this Privacy Policy.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our data practices, the Service, applicable law, or regulatory requirements. When we make material changes, we will update the "Last updated" date at the top of this page and notify all active account holders by email at least fourteen (14) calendar days before the changes take effect. We encourage you to review this Privacy Policy periodically.

Your continued use of the Service after the effective date of any updated Privacy Policy constitutes your acceptance of the changes. If you do not agree to the updated Privacy Policy, you must stop using the Service before the effective date and may request account deletion at privacy@kyrtn.com.

Cookies and Local Storage

Kyrtn uses a small number of cookies and browser storage technologies:

  • Authentication: Supabase-issued session cookies that keep you signed in. These are strictly necessary for the Service to function.
  • Analytics: when you view a published program, we store a randomly generated anonymous session identifier in your browser's local storage. This is used solely to measure program reading sessions and is not linked to your identity or used to track you across the web. Local storage is not a cookie and is not shared with third parties. We do not place this identifier on the devices of visitors in the EU, EEA, or UK; for those visitors we keep only an anonymous count that a view occurred, with no identifier and no behavioral data.
  • Payments: Stripe sets cookies on its checkout and billing portal pages to detect fraud and complete transactions securely. These are governed by Stripe's own cookie and privacy policies.

We do not use third-party advertising cookies. We do not use Google Analytics, Facebook Pixel, or any other third-party tracking or advertising technology.

When you view a published program, your approximate geographic location (country, region, and city) is derived from your IP address using ip-api.com solely for anonymous audience analytics. This is not linked to your identity or your Kyrtn account.

You can clear cookies and local storage at any time from your browser settings. Clearing cookies will sign you out of your Kyrtn account. Clearing local storage will reset your anonymous program session identifier.

Your Privacy Rights

Kyrtn is committed to giving you control over how your information appears on the platform. Here is what you can request and how.

Name correction

You can request a name change at any time, for any reason: legal name change, gender transition, spelling correction, or anything else. We update your name across your profile and all associated program credits without requiring explanation or documentation.

Profile unlisting

You can request that your public profile be removed from public access. Your profile will no longer be visible or searchable, but your credit records are preserved internally.

Full account removal

You can request deletion of your Kyrtn account and personal information. Your account and profile will be removed. Your credited name may remain in historical program records at the discretion of the publishing organization, as programs are permanent historical documents. Credits for individuals under 13 are removed completely and immediately upon a verified parental request, without exception.

Data export

You can request a copy of the personal information Kyrtn holds about you.

If you appear in a Kyrtn program but don't have an account

You can still submit a privacy request at kyrtn.com/privacy-request. You do not need a Kyrtn account to request a name correction or removal. Contact the producing organization directly only for disputes about the accuracy of your credit. They are responsible for what they publish.
